Easements and Deeded Property

General

Appurtenances of water distribution systems and sanitary sewer systems owned by the SCWA are often located within streets and public right-of-ways. When a public street right-of-way is not available, these appurtenances must be placed within an easement granted to the SCWA. Easements should not encroach upon a structure's foundation.

On-Site Easements

"On-site" easements are located within the boundaries of the current phase of development, as shown on the plat and recorded during the Deed of Conveyance and final plat process. The Developer must grant SCWA the exclusive rights to construct, reconstruct, operate, maintain, repair, replace, improve, alter, remove, relocate, and inspect water distribution and sanitary sewer systems situated on the Developer's property.

Off-Site Easements

"Off-site" easements are located outside the boundaries of the current phase of development and must be provided and recorded by the Developer using an SCWA easement document for each property owner. Before obtaining an easement from a property owner, the Developer must submit and obtain approval for plans and an easement plat.

Easements on property owned by the Developer, including water and sewer lines intended for future phases of the same project, should be handled as routine off-site easements. The Developer is responsible for negotiating and acquiring off-site easements with property owners.

Construction of off-site water distribution and sanitary sewer systems cannot begin until all off-site easements required for system completion are approved, acquired, recorded, and received by SCWA.

Easement Width

The minimum width for a permanent on-site or off-site easement associated with water distribution system appurtenances is 10 feet, while sanitary sewer system appurtenances require a minimum width of 20 feet. The SCWA Engineer may adjust the easement width or size as needed.

Easement Sheet Submittal Guidelines

Easement documents are accepted in size 8.5x11. Digital files must be black and white, 300 DPI, and less than 20MB in size. These specifications ensure the best quality when recorded at the courthouse. While the physical size of the document can vary, it must be able to be reduced to these settings and still remain legible.
